Notwithstanding anything to the contrary in the Lease Agreement (including any schedules and guarantee agreements appended thereto) or any related agreement, the Lessee may request a deferral of the lease term start date indicated in Section C of the Lease Agreement (“Lease Start Deferral”) in writing before 5:00 PM (Montreal time) on August 15, 2021 if the Lessee is denied a visa and/or other permit (“Visa”) to enter Canada. The Lessee agrees and acknowledges that the Lessee will provide any substantiating documents, including but not limited to proof of Visa denial, official communications and any other ancillary documents as may be required by the Lessor or its solicitors, in their sole, absolute and unfettered discretion, in considering requests for Lease Start Deferral and throughout the term of any Lease Start Deferral. For clarity, no Lease Start Deferral will be granted for Lessees who have a Visa to enter Canada and who are enrolled in any course or courses at a post-secondary education institution located in Greater Montreal which are offered in any way on campus, exclusively online or in any mixed on campus/online format. The Lessee acknowledges and accepts that the Lessor will not consider requests for Lease Start Deferral made and/or received after 5:00 PM (Montreal time) on August 15, 2021. Any Lease Start Deferral granted by the Lessor will defer the start of the Lessee’s lease until their arrival date into Canada after Lessee is granted a Visa to enter (the “Deferred Lease Start Date”). The Lessee agrees and acknowledges that the Lessee will provide any substantiating documents, including but not limited to proof of the date on which their Visa was granted, travel documentation, official communications and any other ancillary documents as may be required by the Lessor or its solicitors, in their sole, absolute and unfettered discretion, in determining the Deferred Lease Start Date. The Lessee agrees and acknowledges that the Lessee’s failure to provide any substantiating documents requested by the Lessor in connection with determining the Deferred Lease Start Date will give the Lessor the right to determine the Deferred Lease Start Date in its sole, absolute and unfettered discretion.
