Full Cancellation Policy

Unless otherwise provided under the law, if Tenant moves out of the Apartment before the end of this Lease (abandons the apartment) without the prior written consent of Landlord neither this Lease nor the Term of this Lease will be deemed ended except at Landlord's sole discretion, and Tenant will remain responsible for each monthly payment of rent as it becomes due until either the end of this Lease or until Landlord, in Landlord's sole discretion, chooses to end this Lease for default as provided in Article 16.16. DEFAULT OF TENANTS a. Tenant shall be deemed in violation and default of this Lease if: i. Tenant fails to carry out any of the agreements or provisions or obligations of this Lease (excepting only the agreement to pay rent which is subject to the provision of Article 17 Section (a) herein below) and/or Landlord's Rules and Regulations; or ii. In Landlord's sole discretion, Tenant, occupants of the Apartment or Tenant's servants, employees, guests and/or invitees engage in any misconduct or objectionable conduct, which shall be understood for the purposes of this Lease to include, but not be limited, to any conduct or behavior which makes or will make the Apartment or the Building less fit to live in for any other tenants or occupants of the Building or which interferes with the right of others to properly and peacefully enjoy their Apartments, or which causes conditions that are dangerous, hazardous, unsanitary and/or detrimental to other tenants in the Building or which interferes or impedes Landlord's operation and/or management and/or servicing of Tenant, other tenants, the Building or other surrounding common areas owned by Landlord, or interferes with the rights of Landlord, of its employees, contractors and other persons whom Landlord permits on the premises or whom Landlord retains or which exposes any of the foregoing to danger, hazard or possible impairment of rights or conditions; or iii. Tenant fails to take possession of and occupy the Apartment within fifteen (15) days from the date the Apartment becomes available for occupancy; or iv. Tenant and other legal occupants of the Apartment move out permanently, abandon the Apartment as defined in Article 1, before this Lease ends, then the Tenant is required to pay the Landlord the lesser of (a) an amount equal to three (3) month’s rent, plus returning any rent concessions, or (b) the remaining term of the lease. In addition, Tenant is required to provide the Landlord thirty (30) days written notice and pay the rent through that thirty (30) day term; or v. Tenant's Application, which is considered to be and is a part of this Lease, is found to contain any material omission or untrue statements of material fact or was supported by any false statements, misrepresentations, inauthentic documents or other false proffers by Tenant or persons acting for or on behalf of Tenant. 8 b. Upon discovery of any such violation and default, Landlord may give Tenant ten (10) days written notice to cure the specified default. c. If Tenant has not cured the default within the ten (10) day period, the Landlord may then terminate this Lease by proper notice under law, and at the end of said notice period this Lease shall end and Tenant must vacate and surrender possession of the Apartment to the Landlord. In the event of such termination Tenant shall remain responsible to the Landlord as agreed in Article 1, Article 8 and elsewhere in this Lease. d. Tenant agrees that any violation of any article of this Lease which occurs three (3) or more times in any 12 month period shall be deemed a violation not eligible to be cured. This shall not be the exclusive definition of a non-curable violation of this lease. If in the sole and absolute determination of the Landlord, the misconduct or default is one that is not capable of cure or eligible for cure, the Landlord need not give the ten (10) days' notice to cure the violation or default but instead may immediately give notice to Tenant terminating this Lease and Tenant then must vacate and surrender the Apartment to the Landlord following such notice. In the event of such termination Tenant shall remain responsible to the Landlord as agreed in Article 1, Article 8 and elsewhere in this Lease.
