Refund Policy

Deferment and Cancellation Policy for new students affected by the travel restrictions imposed by the Australia Government Scenario 1: Deferment for New Bookings New students who are not allowed to enter Australia due to travel restrictions, and domestic students who cannot arrive to site due to interstate borders closure, will be granted a deferment of their contract start date until when the travel restrictions are lifted, or when they check in to dwell, whichever occurs earlier. Rent will not be charged during the deferred period. All the terms and conditions of their current signed tenancy agreement (length of the tenancy, room type and rental rate) remain the same. Students need to email dwell to inform the staff of their predicament and provide proof to qualify for this deferment. The request must be made at least 7 days prior to the contract start date. Scenario 2: Deferment of studies from Semester 2 2020 to Semester 1 2021 New students affected by travel restrictions who defer their courses to Semester 1 2021, or whose Universities do not offer face-to-face courses, will be granted a deferment of their contract start date to Semester 1 2021. Rent will not be charged during the deferred period. All the terms and conditions of their current signed tenancy agreement (length of the tenancy, room type and rental rate) remain the same. Students need to email dwell to inform the staff of their predicament and provide evidence of enrolment deferral to 2021. The request must be made at least 7 days prior to the semester 2, 2020 contract start date. Scenario 3: Cancellation for New Bookings New students who are not allowed to enter Australia due to travel restrictions, and domestic students who cannot arrive to site due to interstate borders closure, will be granted a cancellation of their tenancy agreement. Cancellation fees will be waived and all payment made will be refunded. Students need to email dwell to inform the staff of their predicament and provide proof that they are not Australia Citizens or residents, and are currently located in countries falling under the travel restriction from the Australian Government. The request must be made at least 7 days prior to the contract start date. Cancellation will also be granted to new students if : • they are not granted a visa or a place at University • due to medical conditions related to COVID-19 • University does not offer face-to-face classes dwell East End Adelaide – Cancellation policy 1. Booking Terms and Conditions After submission of application, a room offer email will be sent to applicant. A holding deposit equivalent to 1 week’s rent is to be paid within 3 days from the date of the room offer email in order to successfully hold the room assigned. The holding deposit will be transferred to the first 1 week’s rent when applicant have entered into a tenancy agreement with dwell East End within 7 days from the date of the room offer email. If a tenancy agreement is not signed within 7 days from the date of the room offer email, unless agreed by dwell East End, the assigned room will not be held for the applicant and any holding deposit paid will be forfeited. Within 48 hours from the time the payment of the holding deposit is made, applicant can cancel the application and obtain a refund of the holding deposit, less an administrative fee of $50. After the 48 hours, the holding deposit will not be refunded, with the exception of first-year students who did not secure a university offer or a visa*. A bond equivalent to 4 weeks rent is to be paid within 14 days from the date of the room offer email. The bond is lodged with Consumer and Business Services (CBS) as according to the Residency Tenancy Act. To withdraw an application, you will need to submit your intention to withdraw in writing to us at StayEastEnd@dwellstudent.com.au. *Relevant supporting documents must be submitted. Other terms and conditions may apply. For more details, please refer to our FAQ. 2. Cancellation received after payment of Holding Deposit/Bond but before signing of Residential Tenancy Agreement a. Cancellation requests must be submitted in-writing via e-mail to: StayEastEnd@dwellstudent.com.au A Request to Terminate Reservation form will be sent to applicant for completion. b. Administrative fee of $50 is payable if the termination is requested within 48 hours from the payment of the holding deposit and the Residential Tenancy Agreement has not been signed. c. If the termination of reservation request is made 48 hours after the payment of the holding deposit/bond and before the tenancy agreement is signed, only the holding deposit is forfeited. Any other payment made in accordance to this reservation will be returned back to applicant. 3. Cancellations received before the signed Residential Tenancy Agreement commencement date a. Cancellation requests must be submitted in-writing via e-mail to: StayEastEnd@dwellstudent.com.au b. If cancellation is requested before the agreement start date the customer is liable for the payment of rent for the room as stated in the tenancy agreement until an approved replacement is found. Please be aware that dwell East End is obliged to fill rooms that are already vacant before newly departed rooms can be filled, following a queue. c. dwell East End reserves the right to recover reasonable costs (included but not limited to cleaning, advertising, administration costs and loss of rent) for agreement cancellation and early termination from the holding deposit or bond payments until a replacement tenant is found. A Cancellation /Reletting Fee of $150 applies and must be paid directly to Dwell East End as it cannot be deducted from the bond. d. Residents are responsible for rental payments according to the Residential Agreement for the whole period of their agreement or until such time as an approved replacement is found (whichever comes first). e. dwell East End must approve all replacement tenants. Replacement tenants must be students from a higher education institution and cannot be existing tenants with whom dwell East End already holds an agreement. 4. Cancellations received after the signed Residential Tenancy Agreement commencement date a. Cancellation requests must be lodged by completing a Notice to Leave by Tenant, available upon request at dwell East End Reception. b. A Cancellation /Reletting Fee of $150 applies and must be paid directly to Dwell East End as it cannot be deducted from the bond. c. Residents are responsible for rental payments according to the Residential Agreement for the whole period of their agreement or until such time as a suitable replacement is found (whichever comes first). Please be aware that dwell East End is obliged to fill rooms that are already vacant before newly departed rooms can be filled, following a queue. d. dwell East End must approve all replacement tenants. Replacement tenants must be students from a higher education institution and cannot be existing tenants with whom the dwell East End already hold an agreement. e. The outgoing tenant should allow at least 3 working days for cleaning and maintenance to be done after their departure and prior to the contract commencement date of the incoming tenant. Rent for such time and the cleaning fees are payable by the outgoing tenant to dwell East End prior to departure. f. Departing tenants are required to complete a Bond Claim Form prior to departure. Bond monies will be processed on the updated end date of the current Residential Tenancy Agreement, subject to apartment inspection following dwell East End Rules. g. On the day of departure, room key is to be returned to Reception prior to 10:00am. Keys returned after 10:00am will incur additional charges unless prior arrangements have been made with dwell East End Administration. 5. First Year Students First-year student or a student studying for the first time at University, or transferring from a University outside of Adelaide (“First Year Student”) can enter into a Residential Tenancy Agreement at dwell East End before receiving and accepting an offer for admission to study. dwell East End will release any such qualifying First Year Student from their Residential Agreement subjected to the following conditions: i) The education institute DOES NOT offer an admission to study to the First Year Student ii) Documentation with supporting evidence (for example notification from the University) must be given and received by dwell East End within 10 days from the date whereby the education institute releases its main offers for admission to study (Academic year / Semester 1 or Semester 2) Once the proper documentation is received by dwell East End, the Residential Agreement will cease. The liability under the Residential Agreement will be limited to the Residential Fees and other charges payable under the Residential Agreement from the contract start date to the date dwell East End Management receives the Resident notification. Cancellation requests should be sent to StayEastEnd@dwellstudent.com.au 6. Cancellation of an agreement – due to no VISA (International Students) Eligible international students can enter into a Residential Tenancy Agreement at dwell East End before a VISA is granted by the relevant government authority with the knowledge that Residential Tenancy Agreement can be terminated with limited liability. dwell East End will release any qualifying international students (students coming from overseas), up to and including the first 14 days from the start date of the Residential Tenancy Agreement. What should I do if I am declined a Visa? If you are notified by Department of Immigration that you are not granted a Visa to study in Australia a. You must notify dwell East End Management in writing (Resident Notification) within 3 days from receiving notification from the Department of Immigration. Please send an email with your declined Visa documentation attached to StayEastEnd@dwellstudent.com.au b. If you comply with all of the above terms, your liability under the Residential Agreement will be limited to the Residential Fees and other charges payable under the Residential Agreement from the contract start date to the date dwell East End Management receives the Resident Notification from you. Your holding deposit (1 weeks rent) and any advanced rent payment made to dwell East End will be returned to you. c. Any resident cancelling after the first 14 days of your lease agreement commencing is liable for rent until a replacement is found.
