Refund Policy

COVID-19 Terms and Conditions
At Cloud Student Homes we understand how important it is to make the right decision with choosing your student
accommodation, as this is often made prior to receiving your exams results and confirmed offer from your University. We
have therefore outlined the changes to our standard Terms and Conditions due to the COVID-19 outbreak so to provide as
much flexibility for your September 2020 stay.
If you are wishing to cancel your tenancy due to the COVID-19 outbreak then the following policy applies in replacement
of the standard Cancellation Terms and Conditions;
4. Cancellation Policy
4.1 Cancellation before moving in
To confirm your room you will need to ensure that you have completed your Assured Shorthold Tenancy (AST) agreement
via StuRents and paid your deposit.
Once you have completed the AST you have until (but not including) 1st August 2020 to be able to cancel your tenancy with no penalty. Any requests outside the above period will require you to find a student to replace you, who in turn will need to complete the AST and paid their deposit via StuRents. Once they have passed the 7 day cool off period you will be
released from the tenancy.
4.2 Travel
Due to the COVID-19 travel restrictions to the United Kingdom, if you are unable to travel to your accommodation you will
need to provide written evidence from the Government in your homes country (translated into English), to support the
restrictions at the time of your cancellation.
You will need to let your accommodation team aware of the cancellation no later than 14 days prior to your tenancy start
date, this notification will need to be accompanied with the Government notification as above.
Your accommodation team will then be able to assess the cancellation request and refund your deposit and release you
from your tenancy agreement for 2020/21.
If you do not provide the appropriate evidence, or within the timescales above then you will he held to the full terms of
your AST and full rental payments.
4.3 Visas
If you are due to stay with us however are unable to obtain a Visa either due to the restrictions on travel, or the Visa offices
are currently closed then we will try to hold your room for you whilst your Visa has being processed. You must ensure that
you are informing your accommodation team if your Visa is being delayed.
If your Visa has been refused then you will need to contact your accommodation team within 5 days of the refusal with the
evidence of the refusal in order for your cancellation to be processed and deposit refunded
4.4 First Year Students
No Place No Stay – if you are not successful in gaining your place in your chosen University then you will need to contact
your accommodation team within 5 days of being made aware in order to cancel your AST and your deposit refunded.
If you do not provide the appropriate evidence, or within the timescales above then you will he held to the full terms of
your AST and full rental payments.
Cloud Student Homes does have accommodations across the country, so do speak to the team and we may be able to
accommodate you in another property.

Rentalinvest Limited – Cancellation Policy
Cooling Off Period
1. Unless you have already collected the keys to the accommodation, you may cancel your booking by writing or sending an e-mail to us at accounts@rentalinvest.co.uk, at
any time during the 3 days after you send back the contract signed by yourself (the “3 Day Cooling-Off Period”). If you do that, we will make no charge and will return any deposit or any payment of advance rent to you.
2. Provided the 3 Day Cooling-Off-Period has expired, you will have to pay all amounts due under your Tenancy Agreement unless a replacement Tenant is found for your Room or you enter into a new Tenancy. If a replacement Tenant is found for your
Room before your start date, we will release you from your Tenancy Agreement on the date three days after the new Tenant’s Tenancy Agreement is signed. If a replacement Tenant is found for your Room after your start date, we will release you
from your Tenancy Agreement from the start date of the
replacement Tenant's new Tenancy Agreement. If you have occupied the Room prior to this, you will be charged £50.00 to cover our costs of preparing the Room for the replacement
Tenant.
No Place No pay
If the student fails their exams or is rejected by the UK University, the student needs to send us the university rejection letter, or proof that the exam results don’t meet the requirements
of the university, and we will cancel the booking and refund the money to the student. The student must send us the proof documents within 7 days of receiving them. This policy is
valid until the 31st August.
No Visa No pay
If the student doesn’t get his visa to come and study in the UK, the student must send us the visa application rejection letter within 7 days of receiving it and we will cancel the booking
and refund the money to the student. This policy is valid until the 31st August.
The cancellation requests along with the proof documents must be sent by the student, by email to accounts@rentalinvest.co.uk
Replacement tenant found
If the student finds a replacement tenant to take over his room with the same tenancy length and same weekly rate, we can process the booking for the new student, and once the offer
has been accepted by the new student and his guarantor, and that they have paid the £250 (if applicable), we will release the original student from their contract.
Passed the 31st August, the No Place No Pay and No Visa No Pay do not apply.
The student remains liable for the rent unless they find a
replacement.

Austin Hall & Asquith House – Late Arrival Policy
When a student signs a contract for Austin Hall/Asquith House and due to either:
1. restrictions in travel or delay in receiving Visa;
2. the start of their course in Leeds being delayed due to the Coronavirus;
the landlord accepts that the start date of the contract can be delayed by 4 weeks at a timeand rent will be refunded or not charged for the period the student has not been able to
arrive in the UK.
The student must make us aware of late arrival as early as possible, but no later than 7 days before the start of their contract / the agreed new delayed arrival date.

15 Your consumer right of return and refund
Clause 15 only applies if you are a consumer.
15.1 If you are a consumer, you have a legal right to cancel the User Agreement during the period set out below. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive the Services, you can notify us of your decision to cancel the User Agreement and receive a refund of the Fees that you have paid for Services not yet received.
15.2 Services are deemed to have been received in the following circumstances (in respect of the different products/services on our site listed below):
StuRents Advance subscriptions are deemed to be received when the subscription period has commenced. Subscription periods will either commence from the first calendar day of the purchased month(s) or will commence immediately if a pro-rata subscription has been purchased for the remainder of the current month.
Services for deposit protections carried-out through StuRents are deemed to have been received when the Deposit Protection Certificate ID has been generated.
Services for rent, tenant fee and deposit collections are deemed to have been received when the associated payment collection process has been initiated by StuRents.
Verification payments made as a tenant user or guarantor user at the point of signing an AST or Licence are deemed to have been received when you have submitted your signature through the platform. Payments made as a tenant user in relation to a deposit or admin fee requested from you by a landlord user are subject to the refund terms contained within the AST or Licence you are party to.
Credit Reference Reports are deemed to have been received once the associated AST to which the Credit Reference Reports relate has been submitted to tenant users
15.3 Your legal right to cancel the User Agreement starts with the day the User Agreement is formed. The deadline for cancelling the User Agreement expires after 14 days from the day of the conclusion of the User Agreement. However, once we have completed the Services you cannot change your mind, even if this period is still running. If you cancel after we have started the Services, you must pay us for the Services provided up until the time you tell us that you have changed your mind.
15.4 To cancel a User Agreement, you just need to let us know. You can do this by using any of the methods of communication set out in clause 21 or by completing the cancellation form attached to these Terms. If you send us your cancellation notice by e-mail, then your cancellation is effective from the date you send us the e-mail. For example, you will have given us notice in time as long as you e-mail us before midnight on that day.
15.5 If you cancel this User Agreement, we will reimburse to you all Fees paid by you for Services not yet provided. We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel.
15.6 We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.
15.7 As a consumer, you have legal rights in relation to Services not carried out with reasonable skill and care. These legal rights are not affected by your right of return and refund in this clause 15. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.
15.8 Your right to change your mind in accordance with this clause 15 only applies to Services provided by us to you. It does not apply to any AST that you enter into or any rent, deposits, fees or any other payments made by you to a landlord user in accordance with any AST.
